TERMS & CONDITIONS OF HIRE

Effective for all bookings made with Bounce-mania Ltd

By making a booking with Bounce-mania Ltd, the Hirer confirms that they have read, understood and agreed to the following Terms & Conditions.

1. BOOKING & ACCEPTANCE OF TERMS

1.1 By confirming a booking with Bounce-mania Ltd, the Hirer agrees to be bound by these Terms & Conditions.

1.2 The person making the booking must be authorised to do so and accepts responsibility for ensuring that all users, guests and representatives comply with these Terms & Conditions and any safety instructions provided.

2. OWNERSHIP OF EQUIPMENT

2.1 All equipment supplied on hire or loan remains the property of Bounce-mania Ltd or its suppliers at all times.

2.2 The Hirer acquires no ownership rights in the equipment and must not sell, transfer, sub-let, lend or otherwise dispose of the equipment without the prior written authorisation of Bounce-mania Ltd.

3. USE OF EQUIPMENT & HIRER'S RESPONSIBILITY

3.1 All equipment is used entirely at the Hirer's and users' own risk, whether the equipment is supervised by Bounce-mania Ltd, another person or is self-run.

3.2 The Hirer is responsible for ensuring that the equipment is used only for its intended purpose and in accordance with all operating and safety instructions supplied by Bounce-mania Ltd.

3.3 Once equipment has been installed, it must not be moved, altered, modified, have items added to it, or be used for any purpose other than that for which it was designed without the prior written permission of Bounce-mania Ltd.

3.4 The Hirer is responsible for ensuring that all relevant safety rules and instructions are followed throughout the period of hire.

3.5 The Hirer is responsible for ensuring that adequate supervision is provided at all times, in accordance with the operating instructions supplied with the equipment.

3.6 The Hirer is responsible for ensuring that suitable first-aid facilities are available where necessary.

3.7 Where required, the Hirer is responsible for ensuring that suitable safety barriers are provided and correctly positioned around the equipment.

4. ELECTRICITY SUPPLY

4.1 Where electrical power is required, the Hirer is responsible for providing a safe and suitable electricity supply.

4.2 Any electrical supply provided by the Hirer must be suitable for the equipment being operated and must be used in accordance with applicable safety requirements.

5. DELIVERY, COLLECTION & ACCESS

5.1 Bounce-mania Ltd and its suppliers will endeavour to deliver and collect equipment as close as reasonably possible to the times stated on the booking.

5.2 Delivery and collection times may be affected by circumstances beyond our control, including traffic, weather, previous bookings, access difficulties, breakdowns or other unforeseen circumstances. Bounce-mania Ltd and its suppliers cannot accept responsibility for delays caused by such circumstances.

5.3 The Hirer must ensure that suitable access to the property/site is available at the agreed delivery and collection times.

5.4 Delivery drivers may not be able to wait if access is unavailable. If delivery or collection is delayed because access is unavailable, Bounce-mania Ltd or its supplier reserves the right to return at a later time and charge the Hirer for any additional costs incurred.

5.5 The Hirer remains responsible for the balance of the hire charge even where delivery cannot be completed because suitable access has not been provided.

5.6 The Hirer must ensure that access to the intended installation area is clear and suitable for the equipment and that a responsible representative is available to provide access and confirm the intended positioning of the equipment.

5.7 The Hirer's representative must have authority to accept delivery, sign for the equipment and receive any relevant safety or operating instructions.

6. SITE REQUIREMENTS

6.1 The proposed operating area must be clear of obstacles, hazards and other items that could affect the safe installation or operation of the equipment.

6.2 The Hirer is responsible for ensuring that the proposed site is suitable for the equipment and free from hazards.

6.3 The Hirer must notify Bounce-mania Ltd of any known underground services, including gas, electricity, water, drainage or other services, before installation.

6.4 Bounce-mania Ltd cannot accept responsibility for damage to underground services where their location has not been disclosed or where such services are not reasonably identifiable.

7. ACCESS THROUGH BUILDINGS

7.1 Where equipment needs to be taken through buildings, the Hirer is responsible for ensuring that adequate access is available.

7.2 The Hirer must remove or adequately protect any furniture, fittings, furnishings, decorations or other items that could be damaged during delivery, installation or collection.

7.3 Although every reasonable precaution will be taken, Bounce-mania Ltd and its suppliers cannot accept responsibility for damage to fittings, furnishings or other property where reasonable care has been taken.

8. SIZE & SPACE REQUIREMENTS

8.1 The stated dimensions of an inflatable are the approximate size of the equipment itself and do not represent the total space required for safe installation and operation.

8.2 As a general guide, the Hirer should allow a minimum additional space of approximately:

  • 3 feet in width
  • 10 feet in length
  • 1 foot in height

8.3 These are general guidelines only. Additional space may be required depending on the particular equipment, access, anchoring requirements and installation conditions.

8.4 If the Hirer is unsure whether the equipment will fit, they must check the available space before the booking and contact Bounce-mania Ltd for advice.

8.5 If Bounce-mania Ltd arrives at the venue and the booked inflatable cannot be safely installed because insufficient space is available, the Hirer will remain liable for the full hire charge.

9. OUTDOOR HARDSTANDING & ANCHORING

9.1 Where inflatables are booked for outdoor use on suitable hardstanding, it may be necessary to drill anchoring points into the surface using a 10mm drill.

9.2 Bounce-mania Ltd can only drill into suitable concrete or tarmac surfaces.

9.3 Bounce-mania Ltd will not drill into block paving, paving slabs or crazy paving.

9.4 If, on arrival, Bounce-mania Ltd determines that the hardstanding is unsuitable for drilling, or the Hirer decides that they no longer wish holes to be drilled, Bounce-mania Ltd reserves the right to decline installation.

9.5 In such circumstances, the full hire charge will remain payable.

9.6 Bounce-mania Ltd cannot accept responsibility for damage to flooring, surfaces or hardstanding caused during or following the drilling or anchoring process, despite reasonable care being taken.

10. ARTIFICIAL GRASS

10.1 Bounce-mania Ltd does not normally install inflatables on artificial grass.

10.2 If Bounce-mania Ltd arrives at an outdoor location and the Hirer requests installation on artificial grass or another unsuitable hardstanding surface, Bounce-mania Ltd reserves the right to decline installation.

10.3 Where installation is carried out at the Hirer's request on a surface that would not normally be used, the Hirer accepts responsibility for the suitability of the surface and any associated risks.

10.4 The full hire charge will remain payable where the Hirer requests installation but the equipment cannot subsequently be used safely because of the surface or site conditions.

11. WEATHER CONDITIONS

11.1 The Hirer is responsible for ensuring that inflatables are not used in unsafe weather conditions.

11.2 Inflatables should not be used in heavy rain or unsuitable weather conditions.

11.3 If wind speeds or gusts exceed 24mph (Force 5 on the Beaufort Scale), the inflatable must be deflated immediately and must remain deflated until conditions become safe.

11.4 The Beaufort Scale description for Force 5 is Fresh Breeze — small trees in leaf begin to sway.

11.5 Bounce-mania Ltd reserves the right to cancel, postpone or terminate a booking where weather conditions or the forecast indicate strong winds or gusts of 24mph or above, or where we reasonably consider the conditions unsuitable or unsafe.

11.6 The safety of customers, guests, staff and members of the public takes priority over the continuation of any hire.

12. RAIN & WEATHER-RELATED POSTPONEMENT

12.1 Where rain is forecast, Bounce-mania Ltd will normally deliver the inflatable unless conditions are considered unsuitable or unsafe.

12.2 If the Hirer would prefer to postpone the party or event because of rain, Bounce-mania Ltd will be happy to work with the Hirer to move the booking to another suitable date, subject to availability, at no additional charge.

12.3 Where rain is forecast for most of the day and the Hirer wishes to cancel rather than postpone, the Hirer must contact the Bounce-mania Ltd office as soon as possible.

12.4 Weather-related postponements are subject to availability and must be agreed with Bounce-mania Ltd.

13. CANCELLATION BY THE HIRER

13.1 If the Hirer needs to cancel a booking due to illness or family-related circumstances, Bounce-mania Ltd will, where possible and subject to availability, be happy to move the booking to an alternative date suitable for both parties at no additional charge.

13.2 If the Hirer chooses to cancel rather than postpone, the following cancellation charges will apply:

More than 30 days before the event:
Any deposit or booking fee already paid is non-refundable.

Within 30 days of the event:
The Hirer is liable for 50% of the total hire charge.

Within 7 days of the event:
The Hirer is liable for 75% of the total hire charge.

Within 48 hours of the event:
The Hirer is liable for 100% of the total hire charge.

13.3 Any outstanding cancellation balance must be paid in accordance with the payment terms provided by Bounce-mania Ltd.

14. CANCELLATION OR REPLACEMENT BY BOUNCE-MANIA LTD

14.1 In the unlikely event that an inflatable is damaged or becomes unavailable before the start of the hire, Bounce-mania Ltd will endeavour to provide a suitable alternative.

14.2 If a suitable alternative cannot be provided, the Hirer will receive a full refund of the amount paid for the affected equipment.

14.3 Bounce-mania Ltd reserves the right to cancel a booking where equipment cannot be supplied safely, including where this is due to adverse weather, equipment damage, mechanical failure or circumstances beyond our reasonable control.

15. DAMAGE, LOSS & FAULTS

15.1 Any equipment lost, damaged or destroyed during the period of hire may be charged to the Hirer at the full reasonable cost of repair or replacement.

15.2 Any damage, loss or incident involving the equipment must be reported to Bounce-mania Ltd immediately.

15.3 On delivery, the Hirer or their authorised representative should inspect the equipment and immediately report any visible damage, defect or fault to Bounce-mania Ltd or its representative.

15.4 Where a fault or damage is not reported at the time of delivery, it may be deemed to have occurred during the Hirer's period of responsibility, unless evidence to the contrary is provided.

16. SUB-LETTING

16.1 The Hirer must not sub-let, lend, hire out or otherwise allow another person or organisation to take responsibility for the equipment without the prior written authorisation of Bounce-mania Ltd.

17. LICENCES & PERMISSIONS

17.1 The Hirer is responsible for obtaining any licences, permits, permissions or other approvals required for the use of the hired equipment at the chosen location.

17.2 The Hirer must ensure that the equipment can legally and safely be used at the venue.

18. PAYMENT

18.1 Payment must be made in accordance with the payment terms stated on the Hire Contract or booking confirmation.

18.2 Where the balance is payable on delivery, the balance must be available when the equipment is delivered.

18.3 Where the outstanding balance exceeds £150, the balance must be paid at least 7 day before the event, unless otherwise agreed in writing.

18.4 Bounce-mania Ltd and its suppliers will not be required to leave equipment at the venue if the required payment has not been received.

18.5 Where payment is not available when required, the Hirer may remain liable for the applicable hire and cancellation charges.

19. LATE PAYMENT

19.1 Bounce-mania Ltd reserves the right to charge additional interest on payments received more than 30 days after their due date, where permitted by law.

19.2 Any reasonable costs incurred in recovering overdue payments may also be recoverable from the Hirer where permitted by law.

20. LIMITATION OF RESPONSIBILITY

20.1 Bounce-mania Ltd and its suppliers will take reasonable care when delivering, installing and collecting equipment.

20.2 However, Bounce-mania Ltd and its suppliers cannot accept responsibility for loss, delay, damage or inconvenience arising from circumstances beyond their reasonable control.

20.3 Nothing in these Terms & Conditions is intended to exclude or limit any liability that cannot legally be excluded or limited under applicable law.

21. PERSONAL INFORMATION & PRIVACY

21.1 Bounce-mania Ltd will not sell or share the Hirer's personal information with third parties except where necessary to provide the booked service, comply with legal obligations, protect our rights, or where otherwise permitted by law.

21.2 We will not use the Hirer's email address for unsolicited marketing without appropriate permission.

21.3 From time to time, Bounce-mania Ltd may contact customers regarding relevant products, services or offers where this is permitted under applicable data protection and electronic marketing laws.

22. GENERAL

22.1 These Terms & Conditions apply to all bookings made with Bounce-mania Ltd unless otherwise agreed in writing.

22.2 Bounce-mania Ltd reserves the right to update or amend these Terms & Conditions where necessary. The Terms & Conditions applicable to a booking will normally be those in force at the time the booking is made.

22.3 If any provision of these Terms & Conditions is found to be invalid or unenforceable, the remaining provisions will continue to apply.
